　　由于法律翻譯是一種法律含義的翻譯。所以，法律翻譯和其它翻譯一樣，也包括理解和表達兩個過程。如果譯者不能理解法律原文，就肯定不能表達原文的含義。理解是表達的基礎，沒有理解，根本就無從談表達。特別是英譯漢而言，由于我們是中國人，英語并非是我們的母語，所以在理解英文時就很容易出錯。這就要求譯者在理解英文原文時要勤查工具書，切不可人云亦云，胡亂猜測。
